Terms of use
Effective from June 13, 2026.
1. Seller and contact
The SPANiAI service (the “Service”) is provided by Individual Entrepreneur Anatolii Golovanov (“we”, “us”). Contact: officialspaniai@gmail.com.
2. Acceptance and age requirements
By using the Service you confirm you have capacity to enter into a contract and agree to these Terms. If you do not agree — stop using the Service.
The Service is intended for users aged 16 and over. If you are under 13, you may not use the Service under any circumstances (US Children's Online Privacy Protection Act — COPPA). If you are between 13 and 15 and reside in the EU/EEA or the United Kingdom, you may only use the Service with verifiable consent from a parent or legal guardian (Art. 8 GDPR / UK GDPR). We will delete an account upon notice that it belongs to a child below the applicable age.
3. Description of the service and nature of AI content
SPANiAI is an online role-playing service where an AI acts as the narrator. We provide access to the interface, AI response generation, saving of adventures and related features.
Responses are produced by a large language model and are clearly identifiable as AI-generated (EU AI Act disclosure). They are not human advice, are not factually verified, and may contain errors, hallucinations or biased content. The Service does not make automated decisions producing legal effects on you (Art. 22 GDPR).
Do not use the Service for: medical, legal, financial, psychological or safety-critical decisions; biometric categorisation; social scoring; or any use prohibited by the EU AI Act.
4. Payments, subscriptions and consumer right of withdrawal
PRO subscription orders are processed by our reseller Paddle.com Market Limited (Paddle), which is the Merchant of Record for all payments. Paddle is responsible for accepting payments, invoicing, taxes, chargebacks and refunds.
Your subscription renews automatically at the end of each paid period (1, 3, 6 or 9 months) at the price announced at the time of purchase, until you cancel it. You can cancel renewal at any time in your profile settings — after that, access is preserved until the end of the already paid period. See also Paddle Buyer Terms.
If you are a consumer in the EU/EEA or the United Kingdom, you have a 14-day right of withdrawal from a paid subscription without giving reasons (Directive 2011/83/EU). By starting to use the paid Service immediately upon purchase, you expressly consent to its provision before the withdrawal period ends and acknowledge that, once the Service has been fully provided, the right of withdrawal is lost. Notwithstanding the above, our Refund Policy grants a 14-day money-back guarantee processed by Paddle.
5. Prohibited use
You agree not to:
- violate applicable law or third-party rights;
- commit fraud, spam or abuse the service;
- scan, break or attempt to bypass technical restrictions;
- generate or distribute illegal content: child exploitation, incitement to violence, hate speech, non-consensual deepfakes, malware;
- pass off AI responses as human advice in regulated areas (medicine, law, finance) without your own verification.
6. User content, intellectual property and DMCA
You are responsible for your prompts, for use of generated content, and for having the rights to any materials you upload. You grant us a limited license to store and process your content solely to provide the Service.
AI responses may be inaccurate. Do not rely on them for professional decisions without your own verification.
We reserve the right to remove content that violates these Terms and to limit or suspend accounts for repeated or serious violations.
The Service, its code, design, trademarks and documentation remain our exclusive property. You are granted a limited, non-exclusive, non-transferable right to use the Service within the chosen plan.
DMCA notice and takedown (US): if you believe content available through the Service infringes your copyright, send a DMCA notice to officialspaniai@gmail.com including: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the infringing material and its URL; (d) your contact details; (e) a good-faith statement; (f) a statement, under penalty of perjury, that the information is accurate and you are authorised to act. We will remove or disable access to material that is the subject of a valid notice and terminate accounts of repeat infringers.
7. Disclaimer of warranties and limitation of liability
The Service is provided “as is”, without warranty of uninterrupted or error-free operation. To the maximum extent permitted by law, we disclaim all implied warranties of fitness for a particular purpose.
To the maximum extent permitted by applicable law, our aggregate liability arising out of or in connection with the Service is limited to the fees you paid to Paddle for the Service in the 6 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, loss of profits, data, goodwill or business interruption. Nothing in these Terms excludes liability for fraud, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.
8. Suspension and termination
We may suspend or terminate access in case of material breach of these Terms, non-payment, fraud/security risk or repeated policy violations.
9. Changes to these Terms
We may update these Terms. We will notify of material changes in the Service. Continued use after such changes means you agree to the updated Terms.
10. Governing law, jurisdiction and dispute resolution
These Terms are governed by the law of Ukraine. Disputes that cannot be resolved amicably are subject to the competent court at the seller's place of registration. Nothing in these Terms deprives consumers in the EU/EEA, United Kingdom, or other jurisdictions of mandatory protections granted by the law of their habitual residence.
Before bringing any formal claim, you agree to first contact us at officialspaniai@gmail.com and attempt to resolve the dispute informally for at least 30 days. This clause does not limit your statutory right to bring proceedings before the courts of your habitual residence (consumers in the EU) or your right to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
